Tribunal awards Rs 31L to mishap victim’s kin
The Motor Accidents Claims Tribunal directed the Reliance General Insurance to pay compensation of Rs 30.6 lakh to the kin of a 29-year-old man, who died in a road accident near Chengalpattu in 2016.

This petition was filed under section 166 of the Motor Vehicles Act and Rule 3 of MACT, claiming compensation of Rs 35 lakh for the death of V Thiyagarajan in a road accident.
According to the petition, Thiyagarajan was riding his motorcycle from Tindivanam to Chennai on December 3, 2016. When he reached near Pukkathurai, a car driven in a rash and negligent manner rammed his bike from behind.
Thiyagarajan sustained grievous injuries and was taken to Government Hospital at Chengalpattu and later referred to Rajiv Gandhi Government General Hospital where he succumbed to injuries the following day. He is survived by wife, a minor son and his parents.
Reliance General Insurance, the insurer of the car, was statutorily liable to pay compensation, the petition said. Countering this, the insurance company denied the allegations and contended that the claim made by the petitioners were highly excessive and without any basis.
Recording the submissions, Judge S Umamaheswari said, “This accident had happened due to rash and negligent driving of the car driver, which was proved from FIR copy and death report.”
After calculating the loss of dependency, loss of consortium, loss of love and affection among others, the tribunal directed the firm to pay Rs 30,63,350 with future interest rate at 7.5 per cent per annum to the kin of the deceased.
