    Madras High Court dismisses bail petition of suspended ACP

    The Madras High Court had denied entertaining a bail application moved by a former assistant commissioner of police, Thirumanagalam range who was booked on charges of abduction, extortion of property and woman harassment.

    Chennai: Justice G Jayachandran held the ruling on dismissing the petition filed by Sivakumar. The petitioner sought to grant anticipatory bail submitting that he was added as an accused in the case due to the personal vendetta.

    However, the government counsel submitted that the petitioner is absconding since the registration of the complaint and his recent suspension. “The arrest and custodial interrogation of the petitioner are imminent, in view of the evidence collected against him,” he said.

    Senior Counsel NR Elango appearing for the accused submitted that the investigation has been completed and the arrest is unnecessary as the complainant and accused had entered a compromise.

    However, the judge rejected such contention observing that the proposed joint compromise between the private party cannot exonerate the alleged excessive force and abuse of power alleged to have been committed by the petitioner.

    “The abscondence of the petitioner all along, though being a senior police officer, discloses his intention and if he is released on bail, he may not be available for investigation and trial,” the judge held while dismissing the petition.

    It is noted that the police officer was booked under sections 147, 323, 347, 384, 420 of the IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act (2019) for allegedly grabbing the lands of Rajesh, a businessman, by abducting him and his fiancée. Inspector, Sub-inspector and other policemen attached to the Thirumanagalam police station were also booked in the case.
