ABVP ex-chief’s suspension from govt service quashed
In a major relief to former ABVP president and surgical oncologist Dr Subbiah Shanmugam, the Madras High Court on Thursday set aside the government’s order suspending Subbiah from his HOD post at Kilpauk Medical College.
Justice D Krishnakumar passed the order on hearing the petition filed by Subbiah challenging the February 17 order of the Directorate of Medical Education (DME) placing the petitioner under suspension from the government post. It was said that the doctor was suspended on charges of violating the TN Service Conduct Rules, 1973 by involving in political activities.
On recording the submissions by either side, Justice Krishnakumar quashed the suspension order and directed the DME to complete the inquiry within 12 weeks.
Dr Subbiah challenged the GO stating he has not involved in any political activities. “The petitioner was the president of ABVP from 2017 to 2020. ABVP is just a students’ forum and not a political party. The petitioner did not leave any political comments as alleged,” senior counsel Vijay Narayan, appearing for Subbiah, submitted. TN AG countered by saying ABVP is a political outfit and it’s a prima facie case as the petitioner had posted political comments on his Twitter handle.
Action against Subbiah was initiated after he met a team of arrested ABVP members.
