CHENNAI: Heading the first bench along with Justice Sunder Mohan, the Acting Chief Justice M Duraiswamy of the Madras High Court on Thursday set aside an order of a single judge quashing the government order to remove the office bearers, including the chairperson and members of the Tamil Nadu Commission for Protection of Child Rights (TNCPCR).

The bench passed the orders on disposing of an appeal preferred by the State government. The State prayed for striking down the order of the single judge’s July 2022 order. It informed the court that the judge failed to consider the fact the government is conferred with the power to remove the chairman and members of the TNCPCR as per the TNCPCR Act, 2005.

Recording the submissions, the bench passed an interim stay and adjourned the matter to October 10.

On February 23, the state passed a GO to remove the chairman and members of TNCPCR. Therefore, the chairperson of TNCPCR Saranya T Jaikumar, and other members challenged the GO before the HC. After hearing the arguments, Justice Abdul Quddhose ordered a temperoray relief in favour of the chairperson and members of the TNCPCR.
