    The Corporation submitted that it has taken a decision to dismiss the petitioner in 2014 after the Madras High Court passed a direction to consider the representation of the petitioner to admit him back to duty.

    CHENNAI: The Madras High Court dismissed a petition with a penalty of Rs 5,000 on a former Tasmac employee who sought direction to the Corporation to admit him to the job. The Tasmac administration dismissed him from the service in 2014 citing that he did not come to the service for more than eight years.

    Justice R Suresh Kumar passed the direction after hearing the petition filed by G Vijaya Kumar, a former sales assistant with Tasmac.

    The Corporation submitted that it has taken a decision to dismiss the petitioner in 2014 after the Madras High Court passed a direction to consider the representation of the petitioner to admit him back to duty.

    Tasmac submitted that the petitioner did not come to the service properly and he took leave for more than eight years. However, the petitioner claimed that he was absent for three years only and which was due to personal reasons. Owing to his family situation, the petitioner wanted to join the duty back.

    Nevertheless, the judge held that if the petitioner is aware of his family’s condition, he should have properly gone to duty with the Tasmac.

    “Pursuant to the order passed by this court in the first round of litigation, the inquiry was conducted and he was removed from service by the orders passed by the respondent Tasmac dated August 08, 2014, and that was also not challenged and it has become final, now, after eight years of that order dated August 08, 2014, the present representation once again was submitted by the petitioner on August 23. Therefore, the question of considering such representation does not arise,” the bench held.
