Petitioner directed to approach appropriate forum to settle land registration disputes

When the first bench comprising Chief Justice Indira Banarjee and Justice M Sundar resumed its sitting after vacation, an advocate Haja Mohideen Kishti made a mention that despite the orders passed by the same bench that the registration of unapproved plots can transpire as per the rules framed by the government, it failed to happen. 

The bench on pointing that the court had already passed orders that land registrations can go on, but is subject to the outcome of the final orders in the writ petition, said, “If the authorities refuse to register, the petitioner is at liberty to approach an appropriate forum for remedy but not this court.” It may be noted that the Madras High Court in May had permitted the sale and resale of such sites based on the condition that they are strictly in accordance with the new set of rules introduced by the government on May 4 to regularise unapproved plots and layouts in the state. 

As per the May 4 notification, the regularisation of such plots will be done in two stages. In the first stage, the layout will be regularised by CMDA/LPA/Regional Deputy Directors of Town and Country Planning Department concerned, who will examine and issue an in-principle approval of the layout framework plan to the local body concerned. 

In the second stage, the local body will issue a regularisation order and plan as per the in-principle approved layout framework plan after confirming the ownership of the plot and collecting the balance regularisation charges, including other applicable charges.
