According to the petitioner, Krishnasamy, he had parked his car on the roadside due to traffic congestion in Dindigul town on February 23, 2011. Dindigul Town North police SI Suresh rammed into his car from behind. When he questioned the official about this, he was abused and assaulted, Krishnasamy submitted.

He also claimed that he sustained an injury on his right cheek and forehead. Subsequently, Krishnasamy was taken to the police station and a case was filed under various sections. Eventually, when police officials found that he was bleeding in the ear, they took Krishnasamy to the government hospital.

Krishnasamy said he petitioned the Inspector of the said police station and Chief Minister’s Special Cell after coming out on bail, but in vain.

Countering the complaint against him, the sub-inspector denied the allegations and said that he was working on patrol duty on that day. He claimed that Krishnasamy used abusive language and restrained him from performing his duty.

Recording the submissions, D Jayachandran, who presided over the Commission, said, “The sub-inspector had violated the human rights of Krishnasamy, and the latter is entitled to a compensation of Rs 1 lakh. The amount should be paid within one month and it shall be recovered from the sub-inspector.” He also directed the Superintendent of Police, Dindigul, to pass final order on the departmental action initiated against the official, if not done so far.
