    Accidents tribunal awards Rs 63 lakh to bizman

    Two years after a 42-year-old businessman met with an accident near Red Hills and sustained multiple injuries, the Motor Accidents Claims Tribunal (MACT), Chennai, has directed the New India Assurance Co Ltd., to pay him Rs 63 lakh as compensation. The medical board considered the injuries and that he was 75 per cent disabled due to the accident.

    Shauk Abdul Sajid filed the petition under Section 166 of the Motor Vehicles Act and Rule 3 of MACT claiming a compensation of Rs 50 lakh for the injuries he suffered in the accident.

    According to the petitioner, he was riding his two-wheeler from Red Hills to Moolakadai when he was hit by a car from behind on December 20, 2017. The car ran over his legs, and he also sustained multiple injuries over his body. He was rushed to Government Stanley Medical College Hospital and later referred to various private hospitals. He had to undergo seven surgeries.

    Sajid alleged that the car was driven in a rash and negligent manner, which led to the accident. Countering this, the insurance firm denied the manner of the accident as described by the petitioner, and charged him of exaggerating the severity of the injuries to claim compensation.

    Further, it alleged that the accident had occurred due to Sajid’s negligence and maintained that it was not liable to pay any compensation.

    Recording the submissions, Judge Uma Maheswari said, “It is clear that the accident had occurred due to the negligence of the car driver. Therefore, the tribunal holds that Shauk Abdul Sajid is entitled to get compensation and fix the disability as 60 per cent permanent.”
