CHENNAI: The Madras High Court on Monday quashed civil suits filed by daughters of demised Tamil actor Sivaji Ganesan for a direction to restrain, the yester-year matinee-icon’s sons Prabhu Ganesan and Ramkumar Ganesan from selling the shares of Shanthi Theatre Private Limited.

Justice Krishnan Ramasamy dismissed the suits preferred by Shanthi Narayanan and Rajvi Gopinath. The petitioners alleged that they have equal shares on the properties of their parents, i.e., Sivaji Ganesan and Kamala Ganesan. However, the plaintiffs’ brothers have sold some properties without their consent.

They further submitted that the defendants should have received the formers’ approval for selling the shares of Shanti Theatre Private Limited Company.

The defendants submitted through their counsel that the shares were sold only after following all the proper procedures. They informed the court that they exercised the sale as per the will executed by Sivaji in their favor and the same was known to the knowledge of the plaintiffs.

Senior Counsel Sathish Prasaran representing Akshaya Homes private real estate firm submitted that they entered into the business with the Shanthi Theatre Private Limited and acquired the shares in 2010 itself.

Due to family disputes between the plaintiffs and defendants, the real estate concern is finding it difficult to sell houses even though the constructions were completed on the premises of Shanthi Theatre Private Limited.

Concurring with the submissions of the defendants, the judge rejected the civil suits filed by Shanthi Narayanan and Rajvi Gopinath.
