CHENNAI: The Madras High Court on Tuesday rejected a petition filed by Viduthalai Chiruthaigal Katchi (VCK) president Thol Thirumavalavan to review an order passed by the court directing the State police to grant permission to Rashtriya Swayamsevak Sangh (RSS) to hold route-marches across Tamil Nadu.

Justice GK Ilanthiraiyan rejected the review petition filed by Tirumavalavan and observed that there is no necessity to review the order passed by him on September 22.

Thirumavalavan’s counsel submitted that the earlier order needs to be reviewed as the issue involves communal harmony, law, and order problems.

He further submitted that the plea by RSS for a direction to grant permission for the rally ought to have been filed as a civil case.

“However, they (RSS members) filed it as a criminal original petition. As the matter is of civil nature, it should have been heard by a judge having civil jurisdiction,” the VCK leader’s counsel submitted.

He further argued that the case cannot be given as a colour of civil nature merely for the reason that police were arrayed as the respondents.

Recording the submissions, the judge refused to review the plea of Chidambaram MP and dismissed the same.
