High Court notice to state on buying perishables from farmers

A division bench comprising Justice Vineet Kothari and Justice Pushpa Sathayanarayana before whom the plea moved by G Rajesh, a practicing advocate in this regard came up said, “This matter is dealt with by this court for the third time, however, proper pleadings are not fled by either side up to date as to what is the present ground reality.”

Posting the matter to May 12 for further hearing, the bench made it clear that if the state fails to file the counter along with the documents by next date of hearing, we will be constrained to impose cost on the state for not fling the counter.

The bench also pointed out that the Government Pleader claims that a GO has been issued to procure perishable goods and agricultural products at the District level but the same has not been placed on record and that the petitioner has also not filed an affidavit about the current situation which might have improved or remained the same.

The petitioner had sought procurement of the perishables either through the Agriculture Produce Marketing Committee or through any other suitable mode and to compensate the farmers.
