Med college fraud: Case against TD Naidu’s family quashed
Police arrayed them as the accused along with Naidu on charges of cheating students by getting huge sums of money under the guise of offering medical education.
CHENNAI: The Madras High Court quashed FIRs filed against family members of TD Naidu, including his wife and three of his children in medical college fraud case on Monday.
Police arrayed them as the accused along with Naidu on charges of cheating students by getting huge sums of money under the guise of offering medical education.
Justice N Sathish Kumar quashed the case pending with the Judicial Magistrate, Tiruttani on the grounds that the petitioners were only members of the TD Naidu Trust and no other material is available on record attributing any contact of the petitioners or attributing any involvement of the petitioners in running the medical college.
Petitioners namely TD Prabavathy, TD Thathaji , TD Soniya, and Banu were arrayed as A2, A3, A4, and A5 after Naidu.
“Merely because they (petitioners) are family members of A1, they cannot be forced to undergo the ordeal of the trial. The pendency of the proceedings against the petitioners is clearly an abuse of process of Court and it requires the interference of this Court under Section 482 of CrPC,” Justice Kumar held.
The judge also noted that the trial court shall proceed as against the remaining accused as per the law as expeditiously as possible.
